CMS Industries Ltd (“Us”, “We”, “Our”) operate the Aircharge.app, MyAircharge.com and Air-Charge.com websites as well as the Aircharge Qi app on iOS and Android (the “Service”).

This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Service and the choices you have associated with that data. We use your data to provide and improve the Service.

By using the Service, you (the “User”) agree to the collection and use of information in accordance with this policy

Information Collection

We collect various types of information for several purposes, including to provide and improve our services:

• Usage Data: We may collect usage data in the form of interactions with Page Links, the destination of those links, as well as browser type and the time and date of those interactions.
• Location Data: Our services may request permission to access location data to provide services limited by geographical location.
• Cookies: These cookies are in place to control pop-up regularity and to provide table ordering functionality where applicable. These cookies only last 24 hours.
• Personal Data: We may ask you to provide certain personally identifiable information such as First Name, Last Name and Email Address should a sign-in, contact tracing element or request for information, be present on the page.

How we get the personal information and why we have it

The personal information we process is provided to us directly by you for one of the following reasons:

• To provide, maintain and monitor our Service.
• To allow you to participate in interactive features of our service when you choose to do so.
• To gather analysis so that we can improve our Service.
• To provide details and insight, when you choose to do so, to Aircharge Clients for you to participate in their interactive services and loyalty programs.

Retention of Data

Aircharge will retain personally identifiable data only for as long is necessary for the purposes set out in this Privacy Policy.
We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. Aircharge will also retain Usage Data for both internal analysis and for presentation to Aircharge Clients for an indeterminate period. As set out in this Privacy Policy, Usage Data is anonymous and cannot be used to identify an individual.

Transfer of Data

Any Personal and Usage Data collected by our Service, is held, and maintained on Servers within the United Kingdom and the United States of America.
Aircharge take reasonable steps to ensure that all data is secure and in accordance with this Privacy Policy, and that no transfer of Personal Data will take place to an organisation or country unless there are adequate controls in place to ensure security of said Personal information. Usage Data that is provided to Aircharge Clients is anonymous and aggregated to protect your privacy.

Disclosure of Data

Should Aircharge or CMS Industries Ltd be involved in a merger, acquisition or asset sale, your Personal Data may be transferred. We will provide notice when any Personal Data is transferred and becomes subject to another Privacy Policy.

Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (i.e., a court or government agency).

We may also disclose your Personal Data in the good faith belief that such action is necessary to:

• Keep to a minimum, the number of staff that have access to the system.

  You have the right to ask us to provide copies of all personal information held on you. In addition, you can request removal of this information from our systems. This request can be made by emailing support@air-charge.com and requesting we do so.

  You have the right to ask us to rectify personal information you believe is inaccurate or incomplete.
• The right of restriction of processing.
  You have the right to request that we restrict the processing of your personal information.
• The right to object to processing.
  You have the right to object to our processing of your Personal Data.
• The right to data portability.
  You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format.
• The right to withdraw consent.
  You have the right to withdraw consent at any time where we have relied on your consent to process your personal information.

To protect your information, we may ask you to verify your identity before responding to such requests. You are not required to pay any charge for exercising your rights. If you make a request, we will take reasonable measures to ensure you receive a response from us within one month.

If you have any concerns about our use of your personal information, you can make a complaint to us at the address found at the top of this Privacy Policy.

If you are within the EEA, you can also complain your local Data Protection Authority should you be unhappy with how we have used your data.

If you are in the UK, you can complain to the Information Commissioner’s Office (ICO).

Service Providers

We may employ third party companies and individuals (“Service Providers”) to facilitate our Service. These Service Providers provide Service-related functions and have limited access to certain Data to perform these tasks on our behalf. Tasks may include Service platform development and maintenance.

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via an email or other prominent notice on our service, prior to the change becoming effective and update the “Policy Date” at the top of this Privacy Policy.
